Appeal Filing and Hearing

When an application has been, refused there may be an opportunity to appeal the refusal to the Immigration and Refugee Board. This gives an opportunity to challenge the reasons for refusal and may allow an application to continue that might otherwise have failed.

Advantages:

  • Allows the application to be reviewed by a different decision-maker
  • Uses a simpler and faster process than an application for judicial review
  • If an appeal to the IRB is available it must be used before a judicial review can be requested

Requirements:

  • Must have received a negative decision on the application
  • The application must be of certain specific types in order for there to be a right of appeal to the IRB
